1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Chicago Party Bus Fun ("Company," "we," "us," or "our"), governing your use of our website at chicagopartybusfun.com and all transportation services we provide, including party bus, limousine, and coach bus rentals in the Chicago metropolitan area.
By accessing our website, submitting a quote request, or booking a service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use our website or services.
2. Services Provided
Chicago Party Bus Fun provides chauffeured ground transportation services including party bus rentals, limousine rentals, and coach bus rentals for private events, corporate events, weddings, and other occasions throughout the Chicago metropolitan area and surrounding suburbs within approximately 60 miles of downtown Chicago.
All services include a professional, uniformed chauffeur; the specified vehicle for the duration of the reserved time; complimentary wet bar setup (ice, coolers, and glassware) on applicable vehicles; and standard insurance coverage as required by Illinois law.
3. Booking & Reservations
3.1 Reservation Process
Reservations are made by submitting a quote request through our website, by phone at 123-456-7890, or by email at info@chicagopartybusfun.com. A reservation is not confirmed until (a) you have received a written confirmation from us, and (b) the required deposit has been received.
3.2 Deposit
A non-refundable deposit is required to secure your reservation. The deposit amount varies by vehicle type, event date, and duration. The specific deposit amount will be communicated in your booking confirmation. The deposit is applied toward your total rental cost.
3.3 Payment
The remaining balance is due in full no later than 48 hours before your scheduled service date. We accept major credit cards (Visa, MasterCard, American Express, Discover), debit cards, and certified checks. Cash payments may be accepted at our discretion. All prices are quoted in US dollars.
3.4 Pricing
Pricing is based on the vehicle selected, duration of service, date, and any additional services requested. Quoted prices are valid for 7 days from the date of the quote. We reserve the right to adjust pricing for bookings not confirmed within this window. Gratuity for the chauffeur is not included in the quoted price and is at your discretion (industry standard is 15–20%).
4. Cancellation & Refund Policy
- 30+ days before service: Full refund of all payments minus the non-refundable deposit.
- 14–29 days before service: 50% refund of total rental cost (deposit is non-refundable).
- 7–13 days before service: 25% refund of total rental cost (deposit is non-refundable).
- Less than 7 days before service: No refund. The full rental cost is forfeited.
- No-show: If you fail to appear at the scheduled pickup location within 30 minutes of the scheduled time without prior notice, the reservation is considered a no-show and no refund will be issued.
Date changes are subject to vehicle and date availability and must be requested at least 14 days before the original service date. One date change is permitted free of charge; additional changes may incur a $100 rebooking fee.
5. Client Responsibilities
5.1 Conduct
You and your guests are expected to treat our vehicles, chauffeurs, and equipment with respect. The following conduct is strictly prohibited and may result in immediate termination of service without refund:
- Smoking, vaping, or use of any tobacco products inside the vehicle
- Use of illegal drugs or substances inside or near the vehicle
- Disorderly, abusive, or threatening behavior toward the chauffeur or other guests
- Standing or extending any body parts outside the vehicle while in motion
- Overcrowding the vehicle beyond its stated passenger capacity
- Bringing weapons of any kind on board
- Tampering with vehicle controls, safety equipment, or the driver compartment
5.2 Alcohol Policy
Clients 21 years of age and older may bring and consume their own alcoholic beverages on party buses and limousines. The Company does not provide alcohol. It is the Client's responsibility to ensure all passengers consuming alcohol are of legal drinking age (21+). For events with minors (prom, Sweet 16, kids' parties, etc.), alcohol is strictly prohibited and the presence of alcohol will result in immediate termination of service without refund.
5.3 Damages
The Client is financially responsible for any damage to the vehicle, its interior, or equipment caused by the Client or their guests during the rental period, including but not limited to:
- Stains, burns, or tears to upholstery, carpet, or ceiling
- Broken glassware, LED fixtures, or sound equipment
- Damage caused by confetti, glitter, silly string, or similar materials
- Excessive cleaning required due to spills, vomit, or bodily fluids
A damage assessment will be conducted after each rental. Cleaning fees start at $250 and damage repair costs will be billed to the credit card on file. Disputes must be raised within 48 hours of the service date.
6. Company Responsibilities
- Vehicle condition: We guarantee that the reserved vehicle will be clean, mechanically sound, and fully equipped as described at the time of booking.
- Professional chauffeur: Every chauffeur is professionally trained, background-checked, drug-tested, licensed by the State of Illinois, and uniformed.
- Insurance: All vehicles are covered by commercial auto liability insurance as required by Illinois law and federal regulations for passenger carriers.
- Timeliness: We commit to arriving at the scheduled pickup location at or before the agreed-upon time. In the event of a delay due to factors within our control (mechanical failure, driver issue), we will provide a replacement vehicle or a proportional refund for the time lost.
7. Vehicle Substitution
In rare circumstances (mechanical failure, accident, or unforeseen emergency), we reserve the right to substitute a comparable or upgraded vehicle at no additional cost to the Client. We will notify the Client as soon as possible if a substitution is necessary. If a suitable substitute cannot be provided and the service cannot be rendered, a full refund will be issued.
8. Overtime & Extensions
If your event extends beyond the reserved time, overtime will be billed at the applicable hourly rate (communicated in your booking confirmation) in 30-minute increments. The chauffeur will notify the primary contact 15 minutes before the scheduled end time. Overtime charges will be billed to the credit card on file.
9. Route & Itinerary
The chauffeur will follow the agreed-upon itinerary as closely as possible. However, routes may be adjusted due to traffic, construction, road closures, weather, or safety concerns. The chauffeur retains sole discretion over the route driven and may decline to stop at any location deemed unsafe or inaccessible for the vehicle.
Stops at locations that serve alcohol (bars, clubs, restaurants) are permitted only for passengers 21 and older. The Company is not responsible for delays caused by extended stops requested by the Client.
10. Limitation of Liability
To the maximum extent permitted by Illinois law, the Company's total liability for any claim arising from or related to the services provided shall not exceed the total amount paid by the Client for the specific reservation at issue.
The Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of enjoyment, emotional distress, lost profits, or damages arising from events beyond our reasonable control (force majeure), including but not limited to severe weather, natural disasters, government orders, pandemics, road closures, traffic accidents involving third parties, or acts of terrorism.
The Company is not responsible for personal property left in any vehicle. While we make reasonable efforts to locate and return lost items, we cannot guarantee recovery.
11. Indemnification
The Client agrees to indemnify, defend, and hold harmless Chicago Party Bus Fun, its owners, officers, employees, agents, and chauffeurs from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to: (a) the Client's or their guests' violation of these Terms; (b) the Client's or their guests' negligent, reckless, or unlawful conduct; or (c) any third-party claims arising from the Client's use of the services.
12. Force Majeure
Neither party shall be liable for failure to perform obligations under these Terms due to events beyond its reasonable control, including but not limited to severe weather conditions, natural disasters, government orders, civil unrest, pandemics, road closures, or equipment failure caused by third parties. In such events, we will work with you to reschedule or provide a proportional refund.
13. Intellectual Property
All content on our website — including text, graphics, logos, images, and software — is the property of Chicago Party Bus Fun or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without prior written permission.
14. Photography & Media Release
By using our services, you grant Chicago Party Bus Fun permission to use non-identifying photographs and video of our vehicles during your event for marketing purposes (website, social media, promotional materials). No photographs identifying individual guests will be used without explicit written consent. If you prefer that no photographs be taken of your event, please notify us in writing at the time of booking.
15. Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict of law principles. Any dispute arising from these Terms or the services provided shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the dispute shall be resolved through binding arbitration in Cook County, Illinois, under the rules of the American Arbitration Association.
Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction.
16. Minimum Age Requirement
The person making the reservation must be at least 21 years of age. For prom and youth events, a parent or legal guardian (21+) must sign the rental agreement and be designated as the responsible party for the duration of the service.
17. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
18. Changes to These Terms
We reserve the right to update these Terms at any time. Changes become effective upon posting to our website with an updated "Last Updated" date. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms. For active reservations, the Terms in effect at the time of booking shall apply.
